1. INTRODUCTION These Terms and Conditions (“Terms”) govern the relationship between [Your Business Name], a motor vehicle service centre and parts retailer located in the Republic of South Africa (“we”, “us”, or “our”), and the customer (“you” or “your”). 2. SERVICES AND PRODUCTS We offer motor vehicle diagnostic, repair, and maintenance services, as well as the sale of new and used automotive parts and accessories. All services and products are provided subject to these Terms and any applicable laws and regulations of South Africa.
3. BOOKINGS AND TURNAROUND TIME 3.1 Bookings for vehicle services are subject to availability. 3.2 Estimated turnaround times provided at booking are indicative only and may be affected by part availability, workload, or unforeseen circumstances. 3.3 We shall not be held liable for any delays beyond our control.
4. PRICING AND PAYMENT 4.1 All prices quoted are in South African Rand (ZAR) and inclusive of VAT unless otherwise stated. 4.2 Quotations are valid for a period of 7 (seven) calendar days unless otherwise specified in writing. 4.3 Payment in full is due upon completion of services or at the point of sale for goods, unless otherwise agreed to in writing. 4.4 We accept payment via card only. Goods and vehicles shall not be released until payment is received in full.
5. OWNERSHIP AND RISK 5.1 Ownership of any parts or goods supplied remains with us until full payment has been received. 5.2 Risk in and responsibility for the goods shall pass to you upon delivery or collection.
6. RETURNS AND WARRANTIES 6.1 Returns of parts or goods are accepted within 7 (seven) days of purchase, provided they are unused, in original packaging, and accompanied by the original receipt. 6.2 Electrical parts and used parts are not returnable unless faulty upon delivery. 6.3 New parts are subject to the manufacturer’s warranty. 6.4 We provide a 3 (three) month workmanship warranty on repairs performed, subject to proper use and maintenance of the vehicle. 6.5 No warranty shall apply to defects arising from misuse, neglect, or unauthorized alterations.
7. CUSTOMER OBLIGATIONS 7.1 You warrant that all information provided to us is true and correct. 7.2 You are responsible for disclosing all relevant information about the condition of your vehicle. 7.3 You must collect your vehicle within 3 (three) business days of notification of completion, failing which storage charges may apply.
8. LIMITATION OF LIABILITY 8.1 While we take reasonable care in providing services and products, we shall not be liable for any indirect, consequential, or incidental loss or damage. 8.2 We are not liable for damage caused by pre-existing defects in the vehicle, improper use post-service, or failure to follow our recommendations.
9. PROTECTION OF PERSONAL INFORMATION (POPIA) 9.1 We comply with the Protection of Personal Information Act 4 of 2013 (“POPIA”). 9.2 Personal information collected from you, including name, contact details, ID number, vehicle details, and payment information, is used for the purpose of providing services, communicating with you, and maintaining service records. 9.3 All personal data is securely stored and only accessible to authorised personnel. 9.4 We do not sell or share your personal information with third parties, except as required by law or with your explicit consent. 9.5 You have the right to access, correct, or request deletion of your personal information. 10. DISPUTES AND GOVERNING LAW 10.1 These Terms are governed by the laws of the Republic of South Africa. 10.2 Any dispute shall first be attempted to be resolved amicably. If unresolved, it shall be referred to mediation or arbitration, or the appropriate court of law with jurisdiction.
